Please note, additional fees may apply to commissions. Some examples of things which may require an additional fee are:

Additional characters.

Character designing from partial references or written descriptions.

Complex features or backgrounds.

Requiring a non-disclosure agreement (NDA).

Using your commission for commercial purposes.

Any additional fees that apply to a commission request will be communicated clearly prior to any payment being agreed / taken.

By commissioning me, you are only purchasing my service as an artist and the digital .png file(s) of your commissioned artwork.

You must be at least 18 years old to commission me.

It is prohibited to use my artwork for anything related to artificial intelligence, machine learning, and NFTs.

If your commission is intended for personal printing, please let me know so I can send you a printer-friendly copy.

My signature on my artwork must never be removed under any condition.

My public artwork is licensed under the Creative Commons Attribution-NonCommercial-NoDerivatives 4.0 International License, unless stated otherwise.

You should be concise when submitting a form, giving only relevant descriptions and visual references.

If you do not provide enough descriptions and / or visual references I may have to refuse your commission.

Alternatively, you can grant me Artistic Freedom (bear in mind what artistic freedom means).

After reviewing your form you will receive a response from me to your provided email. If accepted a briefing will be conducted to confirm your commission. Please let me know how you prefer to communicate or I will default to emailing.

After confirming your commission I will send an email invoice from PayPal / Stripe in GBP or VGen. Only send payment through this official invoice.

The invoice must be paid in full within 15 days of receipt to begin working on your commission, unless agreed otherwise.

During our briefing, I'll give you an approximate timeline (2 to 8 weeks), but any timescales I provide are only a rough guide and are not binding.

Once I begin your commission I will provide you with updates (e.g., sketch, line art, flat colour), which will allow you to see the progress and confirm your approval.

You can revise your commission 1 time in each step if applicable:

Upon completion you will receive copies of your commissioned artwork, two of them always being:

An unwatermarked digital .png file in high-res.

An watermarked digital .png file in a lower res (for sharing / posting publicly).

Please only upload the lower res file publicly unless otherwise discussed. You are responsible for protecting your copies of your commissioned artwork.

Should a delay occur in completing your commission, you will be informed with a revised timescale.

Your commission completion will be postponed for at least 1 day or more if you don't respond for 24hrs+ when I contact you about your commission.

You may contact me for an update if it has been more than a week since I last contacted you. I will respond as soon as possible.

There will be a priority fee for short timeline commissions. Please understand I may refuse to take up time sensitive commissions.

It is your responsibility to provide accurate references and descriptions for your commission. I accept no responsibility for issues which result from you providing incorrect or outdated information/references. In the event of such an issue I will be happy to discuss the work required to rectify the problem but I reserve the right to charge an additional fee for extra work needed.

I will provide you with a copy of your commission after each major stage of the creation process (e.g., sketch, line art, flat colour) and ask for your approval to proceed to the next step.

You are responsible for confirming you are satisfied with the work completed in the step of the creation process being reviewed and I will not proceed with the commission until you confirm you are satisfied.

If an issue isn't raised during the appropriate review step, I will discuss it with you, but I reserve the right to decline the request or charge an additional fee.

I will take full responsibility if an issue with a commission is identified that is the result of me misinterpreting or diverting from the references and descriptions given by you. These corrections will be done at any stage without charge.

I, the artist, retain the original copyright and ownership of my artworks, which includes but is not limited to:

Redistribute / Reproduce / Promote myself.

Use commercially (you will be notified if I do this).

Claim the creation of designs I’ve made (e.g., character design, outfit design, etc).

Use in any other manner appropriate under UK copyright law.

You, the client, are allowed to:

Use your commissioned artwork for NON-PROFIT use only.

Print / Display / Share your commissioned artwork (e.g., print for yourself with no intention of selling, online display, etc).

Use your commissioned artwork in any capacity pertinent to personal use (e.g., pfps, digital wallpapers, personal website / profile displays, etc).

You, the client, are not allowed to:

Reproduce / Use your commissioned artwork for commercial purposes (e.g., profit from a medium / platform where you use my artwork like selling t-shirts, YouTube videos, business cards, etc) without my consent / written permission.

Take credit for the creation of your commissioned artwork.

Remove my watermarks / signatures.

Make adaptations of your commissioned artwork without my consent / written permission.

It is mandatory to give proper credit to me, “EvyCrystal” for all my artworks.

I will not resell or use your commissioned artwork for commercial gain without your consent / written permission. The copyright of the subject(s) and intellectual property(ies) featured in any commissioned artwork remains solely with the copyright holder and owner of the intellectual property(ies).

If you wish to purchase Commercial Rights to your commissioned artwork this can be discussed and may be agreed for a minimum price increase of 100% of the original price. However, I reserve the right to charge more if I deem fit.

If you break the copyright infringement in any way, your rights to your commissioned artwork will be forfeit and you will be blacklisted without warning.

I reserve the right to cancel and refund your commission at any time.

The refund amount will depend on the amount of work completed (e.g., 50% of progress done, 50% will be refunded).

If you haven't sent payment, you may cancel your commission.

Once payment has been received, you cannot cancel or request a refund.

I will not draw anything that fits within the following categories:

Any subject intended to cause or incite bullying / racism / sexism / homophobia / transphobia.

Original characters that are not owned by you unless you have written permission from the rightful owner.

Robot / Mecha.

Extreme gore.

Underage characters in sexual or any type of suggestive or violent situations.

Non-consensual sex scenes.

Extreme NSFW kinks / fetishes. (Inquire with me for more info.)

Please contact me before commissioning if you're unsure if your commission falls into one of the above categories.

While using my service, I may ask you to provide me with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to:

Email address

Correspondence Address

Most of the personal information I process is provided to me directly by you for one or more of the following reasons:

To enquire about, or request a quotation for, engaging my offered services.

To place an order for goods / services to be provided by me.

To enable me to provide updates on purchases you have paid me for.

To enable the sending of merchandise you have purchased from me.

I use the information that you have given me in order to:

Contact you in response to enquiries or to provide updates on purchases.

Provide invoices to you for billing purposes.

Enable me to send you any physical items you have purchased from me.

Enable the investigation and resolution of any disputes / complaints.

Improve my products and services.

Comply with any legal obligations under UK law.

I may share this information with payment service providers (Paypal, Stripe, etc) and / or postal service providers (Royal Mail, Parcel Force, etc).

Under the UK General Data Protection Regulation (UK GDPR), the lawful bases I rely on for processing this information are:

Your information is securely stored.

I keep records of personal information in digital formats only. These records will be held for a maximum of one calendar year following completion of any enquiries / purchases. I will then dispose of your information by wiping / deleting the digital records.

Under data protection law, you have rights including:

Your right of access: You have the right to ask me for copies of your personal information.

Your right to rectification: You have the right to ask me to rectify personal information you think is inaccurate. You also have the right to ask me to complete information you think is incomplete.

Your right to erasure: You have the right to ask me to erase your personal information in certain circumstances.

Your right to restriction of processing: You have the right to ask me to restrict the processing of your personal information in certain circumstances.

Your right to object to processing: You have the right to object to the processing of your personal information in certain circumstances.

Your right to data portability: You have the right to ask that I transfer the personal information you gave me to another organization, or to you, in certain circumstances.

You are not required to pay any charge for exercising your rights. If you make a request, I have one month to respond to you.
